Free evaluation of OpenMOM version 1.5 for Windows 95, 98, ME & NT, 2000, XP

 

OpenMOM TRIAL LICENSE AGREEMENT

The User wishes to evaluate OpenMOM on the User's computer system. Please consider this as an authorization to download OpenMOM at the indicated location. The User will use OpenMOM for a short evaluation during the specified period on the above designated CPU.
This trial license is granted subject to the following general terms and conditions:

GRANT: This Agreement grants User the right to use OpenMOM on the designated CPU only. No rights of industrial and/or intellectual ownership, title or proprietary rights in OpenMOM shall pass under any circumstances. These rights of usage are granted solely to the User and may not be assigned, transferred or otherwise disposed of.

NONDISCLOSURE: The User acknowledges that OpenMOM and its supporting documentation, and all other materials and knowledge related thereto, are proprietary to 4 Tier Software and contain confidential and proprietary information and trade secrets. The User agrees at all times to hold all such confidential and proprietary information and trade secrets in strict confidence.
User may disclose relevant aspects of OpenMOM to its employees as may be reasonably necessary to the User's use of OpenMOM, provided that the User shall take all reasonable steps to ensure that OpenMOM is not used, disclosed, or distributed by such employees in contravention of the provisions of this Agreement. This nondisclosure provision shall survive the expiration or termination of this Agreement.

WARRANTY: 4 Tier Software represents and warrants that the OpenMOM sofware when delivered will be provided "as is". 4 Tier Sofware does not warrant that the functions contained in the System will meet the User's requirements or will operate in the combinations which may be selected for use by the User, nor that the operation of the Software will be uninterrupted or error free. 4 Tier Software will react to User's reported problems with best efforts including - answer to technical questions - reactions to reported bugs - software/documentation updates. The warranties stated herein are exclusive and in lieu of all other warranties, express or implied, including but not limited to implied warranties of merchan-tability or fitness for a particular purpose.

EXPIRATION/TERMINATION: In the event of expiration or termination of this Agreement, User agrees to cease using OpenMOM and to provide, on request, 4 Tier Software with certification that to the best of User's knowledge and through User's best effort, all copies of OpenMOM, Documentation and other licensed materials have been destroyed or returned to 4 Tier Software. This requirement will apply to all copies in whatever form present at the time of termination.
Any files, procedures or programs copied onto the User's system, or created with OpenMOM will be deleted.
